Employees in Nevada and Arizona claim the c-store chain labeled them managers to avoid overtime pay.

A group of 59 former and current Circle K employees in Nevada and Arizona are suing the convenience store chain for allegedly intentionally misclassifying them as store managers in order to prevent them from getting overtime pay, KNPR News reported.

The class-action lawsuit argues the employees should not have been given management titles because their daily tasks included non-management duties, including unloading boxes and cleaning restrooms.

Las Vegas attorney Andy Rempfer represents the current and former Circle K workers. Rempfer said Circle K does not have discretion to independently categorize workers as managers, especially those employees who just work the cash registers. Mediation between the Circle K workers and the company is scheduled for September.
